Request for Lutz 7-Eleven is delayed

The Hillsborough County Commission voted 4-3 to remand a rezoning request for a gas station and carwash off U.S. 41, north of Sunset Lane, in Lutz.

Commissioners Ken Hagan, Kimberly Overman, Mariella Smith and Chairwoman Pat Kemp voted to remand the request and Commissioners Harry Cohen, Gwen Myers and Stacy White dissented.

Those who voted to send the case back to the zoning hearing master for further review specifically said they want the county’s Department of Environmental Protection to take a closer look at whether a septic system will be capable of  handling the discharge from a proposed carwash.

They voiced concerns about potential problems because the area has lakes, private wells and sensitive wetlands.

Commissioner Smith said the hearing can explore other issues, too.

“I would not have it limited,” she said, noting that citizens are free to discuss other topics, such as light pollution and compatibility, she added.

During the Hillsborough board’s Oct. 12 public hearing, Smith said the county also needs to take a closer look at its rezoning process.

Under current procedures, no testimony can be presented to commissioners during a rezoning hearing unless it was part of the record before the zoning hearing master.

The zoning hearing master recommends approval or denial on zoning cases, but the county board has the final word.

The request, by RKM and 7-Eleven, drew both support and opposition at the county board’s hearing and also at the zoning hearing master hearing on Aug. 16.

Attorney Cami Corbett, representing the applicants at both hearings, described the proposed gas station as a modern building, designed specifically to fit within the character of Lutz.

She said it is within the node that’s specifically designated for neighborhood commercial development within the Lutz Community Plan.

Natalie Davis, of 17880 N. U.S. 41, in Lutz, spoke in favor of the request at both hearings.

She noted that Lutz typically has wanted to slow development — but even so, a significant amount of new projects have popped up along U.S. 41.

Those developments have included a Publix, a Dunkin’ Donuts, restaurants, McDonald’s, a self-storage unit, a Walgreens, a bank, and professional office parks, as well as new neighborhoods.

Davis favors growth along U.S. 41, which she noted is a six-lane road, and questioned why a gas station should be excluded.

“I am here to represent the next generation of Lutz,” she said.

Gus Weekley, who owns the property up for rezoning, along with his brother, said the family has deep roots in Lutz.

The proposed site of the gas station is land that was owned by his grandmother and where she sold fruit raised on the land to those traveling by on the only major road into Tampa.

“We believe that Lutz is a special community,” he said, adding the 7-Eleven will be a good fit.

He noted an error in the hearing master’s record and said that was sufficient to merit a remand.

County staff, however, said that the hearing officer’s recommendation was based on accurate information, despite the error in the report.

Jay Muffly, a longtime community activist, was direct: “I oppose this rezoning because it is not compatible with the Lutz community. Period.”

He also expressed concerns about potential negative impacts from light pollution.

Both Kemp and Overman voiced concerns about allowing a car wash to operate on a septic system.

The idea of dropping the carwash from the application was raised, but the applicant indicated no interest in taking that approach.

The project would hook onto public water and sewer, but it is not available, Corbett said.

Questions also were raised about whether the proposed development meets the county’s locational criteria.

That standard says the project should be within 900 feet of the intersection of U.S. 41 and Sunset Lane. But a portion of the proposed project is 960 feet away from that intersection, according to testimony provided during the county board’s discussion.

Commissioner Hagan initially said he wasn’t sure the board had legal grounds to deny the rezoning.

Ultimately, though, he went along with three of his colleagues when they called for a remand to pursue additional information.

The next hearing has been set for Nov. 15 at 6 p.m.

In-person and remote hybrid Zoning Hearing Master meetings are held at Robert W. Saunders Sr. Public Library, in the Ada T. Payne Community Room, at 1505 N. Nebraska Ave., in downtown Tampa.

Will 7-Eleven set up in Lutz?

A proposed rezoning for a gas station and convenience store, off U.S. 41, north of Sunset Lane, drew both support and opposition during an Aug. 16 hearing.

“We’re planning a brand-new modern building, designed to fit within the character of the Lutz community design standards,” Cami Corbett, an attorney representing the applicant told Susan Finch, the hearing officer on the case.

The proposed development is “a next-generation” 7-Eleven that would be built “at the node that’s specifically designated for neighborhood commercial development within the Lutz Community Plan,” Corbett added.

Three experts spoke on behalf of the applicant.

One offered testimony regarding the steps that are taken to ensure the safety of the fuel tanks and the methods used to capture gasoline vapors.

Another testified that the project will not pose a threat to water quality of private wells in the area.

A third expert discussed traffic issues. He pointed to improvements that are planned at the intersection of Sunset Lane and U.S. 41. He also cited a department of transportation study that estimates that 78% of a convenience store/gas station’s traffic comes from motorists driving by.

Natalie Davis, of 17880 N. U.S. Highway 41, in Lutz, spoke forcefully in favor of the request.

“I grew up in a neighborhood right across from this project, on Sunset and 41. I now own a small business that’s located in Lutz, as well,” she said.

She offered several reasons for her support.

Lutz has typically wanted to slow down development, she said, but in the last 15 years, it has allowed “a Publix, a Dunkin’ Donuts, restaurants, McDonald’s, a self-storage unit, a Walgreens, a bank, professional office parks, and new neighborhoods.

“So, my question is, why not a gas station? And, why not this property?” she asked.

“There’s widespread development to the north of us, on Highway (State Road) 54, and there’s development creeping from the south. And, U.S. 41 is the six-lane highway that runs in between.

“So, to think you’re going to keep Lutz small — that train has left the station. We’re not talking about a small-town road. We’re talking about a six-lane highway. We’re not talking about a nature preserve. We’re talking about a six-lane highway.”

She also thinks Lutz needs more gas stations, plus she supports the property owner’s right to develop the property, she added.

Gus Weekley, who owns the property up for rezoning, along with his brother, said the family has deep roots in Lutz.

“It initially was owned by my grandmother. She bought it decades ago, when (U.S.) 41 was the only major road into Tampa and she sold fruit that was raised on the land, to those coming to the north,” he said.

He recalled spending many summer weekends during his youth, working in the groves.

“We have history of 80 years or so, in Lutz,” he said, noting that he thinks a gas station will be a good addition to the community.

“This is not a case of someone just coming in and saying, ‘Where’s the check? See you later.’’’ Weekley said.

But one area resident raised concerns about locating a commercial business using a septic tank so close to nearby residences that rely on well water.

Sam Calco, president of the Lutz Citizens Coalition, also objected to the request “based solely on the law, as established by the Lutz Comprehensive Plan.”

He contends the proposed rezoning violates that plan and should be denied.

Calco also contends that the request has failed to secure a commercial locational waiver, which he said is required.

“This project is not needed or wanted in Lutz at this time,” Calco said, vowing that he would not support the business.

“I know I will never buy a lottery ticket. Not one candy bar or Slurpee. Not one gallon of gas. Not one bag of ice —  ever — at this business,” Calco said.

“I ask you, our citizens ask you, to simply follow the law,” he told the hearing officer.

Corbett said the rural planning policies prohibit public sewer. If it was allowed, however, the developer would be glad to connect.

“While we had some real passionate people here this evening, I don’t think any of them are experts in the field such as compatibility or transportation or environmental, and so you do have expert testimony in the record, in the form of staff reports from the planning commission, development services and all of our experts to support the application,” Corbett said.

Corbett also noted the application had received no objections from the reviewing agencies.

Finch has 15 days from the date of the hearing to issue her recommendation, which will go to the Hillsborough County Commission, which has final say on zoning and land use issues.

Rezoning request for a gas station in Lutz is up for a hearing

A rezoning request that would clear the way for a gas station, car wash and convenience store in Lutz is set for a public hearing next week.

The request — which has been scheduled and rescheduled — now is expected to be heard at 6 p.m. on Aug. 16, in the Robert W. Saunders Sr. Public Library, 1505 N. Nebraska Ave., in Tampa.

The applicant, RKM Development Corp., is seeking to rezone the 2.6-acre parcel at 18601 U.S. 41, to allow a 4,650-square-foot convenience store and 16 gas pumps, as well as a car wash.

The parcel is adjacent to an existing Walgreens store.

The land, owned by Lutz Realty and Investment LLC, currently is zoned for agricultural and single-family conventional use. The request calls for rezoning the site to become a planned development zoning.

Opponents have voiced objections, which are part of the application case file. They claim the request is contrary to the Lutz Community Plan.

Opponents also cite concerns about increasing traffic at the intersection of Sunset Lane and U.S. 41, which they said already poses dangers for motorists.

Concerns also were expressed about potential water contamination, noise, and negative impacts on property values and the environment.

Those objecting also say another gas station isn’t needed, and some said they won’t patronage the business, if it is built.

After the last hearing was delayed, representatives for the applicant held a community meeting on July 27, which was attended by both supporters and opponents to the request, according to Sam Calco, of the Lutz Citizens Coalition, who was present.

Planners for the Hillsborough County’s Planning Commission have found the request to be consistent with the county’s long-range plan.

“Overall, Planning Commission staff finds this proposed use and intensity to be compatible with the surrounding area,” according to a report by Planning Commission planner David Hey.

“The proposed development also fulfills the intent of the Lutz Community Plan,” Hey added to the report that’s included in the application case file.

Those interested in expressing support or opposition can weigh in at the rezoning hearing — either in person or virtually. Those participating virtually must sign up to do so by the county’s deadline. Check the county’s website for more information.

Once the zoning master makes a recommendation, the request will go to the Hillsborough County Commission, which has final jurisdiction over land use and zoning issues.

Fourth of July sparkles with patriotism

Patriotism was on full display at the Independence Day festivities in Lutz.

Whether they were part of the parade, or on the sidelines watching, people came wearing red, white and blue — and were ready to celebrate.

The nation’s colors showed up everywhere.

They were on flags, in hair ribbons, on cowboy boots and emblazoned on the front of semi-trucks.

The parade, a community tradition, included the usual suspects.

There were Boy Scout troops, Girl Scout troops, elementary school kids and military veterans, too.

The veterans arrived in Jeeps and trucks, on motorcycles and some, riding stylishly, in a motorcade of Corvettes.

Adults and kids rode on floats featuring local businesses and area churches and sports teams.

Belly dancers jiggled their way down the parade route, while dancers from Dancercise showed off smooth moves and kids from martial arts studios broke boards with their hands and feet.

There were even some inflatable characters, including one representing the Civil Air Patrol and the Michelin man, who was there to celebrate the 30th anniversary of Dumas Tire Pros, a Lutz tire and auto repair shop.

“We like to support our community,” said DeWitt Dumas, of Dumas Tire Pros, and the company appreciates the community’s support, he added.

Lots of spectators arrived early to get a nice, shady spot.

Sam Calco was there early, staking out a spot for his family.

“We’ve lived in Lutz since ’87. We’ve made it every year, except for when we were out of town,” said Calco, who found a choice spot, under an oak, next to the library.

Now, with 4-year-old grandson, Leo McCullers, the event is even more fun, Calco said, noting, “He enjoys the beads and the candy and the fire trucks and the police cars.”

Karen Lucchese, another Lutz resident, said the parade is a great way to start Independence Day.

“To me, this is what it’s about. It’s all about hometown America. It’s exactly what you’re supposed to do for the Fourth of July, and it gives you a real sense of community,” said Lucchese, who was at the parade with her husband, Phil, her son, Tyler, his girlfriend, Lexi Neth and some other friends.

Little kids and adults lined the parade route, vying to take home some swag. There were beads, of course, but all kinds of candy, too. Some people walking down the parade route were handing out sunscreen and cardboard fans — welcome gifts on a sunny, sweltering day.

The parade wasn’t the only attraction.

There were amusement games and pony rides for kids, a cake and pie auction.

The cake and pie contest drew 28 entries, including a 5-pound apple pie, a cake shaped like a fish and another with the look of the community’s iconic train depot.

Wilma Lewis had eight entries in the competition.

“I’m thinking she’s wanting one of those blue ribbons,” said Karen D’Amico, who coordinated the competition this year, under the tutelage of Marilyn Wannamaker.

Shirley Simmons entered her famous, made-from-scratch pound cake, which fetched $75 in the auction after the parade.

Another highlight of the day was the swearing-in of Jennifer Rankin, as the honorary Lutz Guv’na for 2015.

It was a moment that Rankin has desired since she was a student at Lutz Elementary School.

Of course, at that time, she thought it was a real political race.

Once she learned it was to raise money for community organizations, she was even more enthused, she said while on the campaign trail.

As a Lutz native who grew up in the family business, Al’s Lawn Care on North Dale Mabry Highway, Rankin said she was pleased to represent the family business which is celebrating its 30th anniversary this year.

She thanked her family members for all of their hard work in helping her to win the race, and she thanked everyone who donated to the cause.

Others competing for the title were Cheryl Lynn Ayers and KarenSue Molis.

Ayers raised more than $2,800 in her bid for the title, Molis raised more than $7,300 and Rankin raised more than $9,200.

“These ladies are awesome,” said Suzin Carr, a two-time Guv’na, who announced the new Guv’na.

“Every penny, nickel, dime — counts,” Carr said. “Last year there were more than 20 local charities here that got a piece of this pie.”

Lutz wasn’t the only place hosting celebrations during Independence Day weekend. The Shops at Wiregrass and the Rotary Club of Wesley Chapel hosted the fourth annual Wesley Chapel Freedom Festival, and the Pasco County Fairgrounds had its annual Sparklebration celebration.

Young girl’s cancer touches community’s heart

Before Natalia Sofia Ricabal began attending Lutz Preparatory School last fall, she worried about how she would fit in with her classmates.

It was her first year at the school, and naturally, she wanted to feel welcome.

Now, the 8-year-old’s concerns have become more serious: She’s not sure when she will walk again. She was diagnosed in August with Ewing’s sarcoma, a form of bone cancer.

Her illness came with little warning, Natalia’s Mom, Amy Ricabal, said.

The grade-schooler had been experiencing some leg pain, off and on, then a few days later a huge red bump appeared on her left leg, which came out of her femur and protruded into the soft tissue, Amy said.

Natalia required surgery, and the surgeon had a choice: Amputate the young girl’s leg or do a limb salvage surgery, Amy said. He did the limb salvage surgery, replacing Natalia’s femur bone with a cadaver bone.

“Thank God they were able to keep the growth plates,” Amy said.

Natalia started chemotherapy at the end of August and began radiation treatments in early February. She has lost her hair, has been nauseated and lethargic, has had low white blood counts, and has had blood transfusions, Amy said. She will require substantial physical therapy and it is unclear when she’ll be able to walk.

It has been difficult to see Natalia in pain, and to recall how only months ago she was doing cartwheels and chasing after her 10-year-old brother Gabriel, Amy said. But Natalia’s story isn’t just about illness. It’s also about faith and the community’s outpouring of love and kindness.

The Lutz Citizens Coalition, Lutz Preparatory School and Tampa Bay Food Trucks are combining to host a fundraiser for Natalia at this month’s First Friday Food Truck Rally. It will take place at Lutz Prep, 17951 N. U.S. 41, from 6 p.m. to 9 p.m., March 7 and will feature a band that has written a song for Natalia.

The Lutz Citizens Coalition is happy to help the Ricabals, said Sam Calco, the coalition’s vice president.

“It’s what Lutz is all about,” he said. “You think about what that family is going through.”

Lutz Prep has demonstrated generosity and warmth at every level, Amy said.

“We’re first-time parents here at the school, and I’m never here because it (Natalia’s health battle) started with the first day of meet and greet,” Amy said. “So, I’m a pretty invisible person.”

The school has embraced the family anyway, and has gone out of its way to support them, using the online voice and video communication service Skype, for instance, to stay in touch when Natalia can’t be in school.

Several students and a teacher also demonstrated their compassion by shaving their heads so Natalia wouldn’t feel conspicuous when returning to school.

The Ricabals have experienced financial challenges, too, as Amy had to step away from her job as an ultrasound sonographer to provide care for Natalia. The family always has relied on both her paycheck and her husband Isaias’s paycheck, Amy said. Her husband is a coach at a charter school.

Amy is not afraid because she knows God will see the family through.

“I just have to focus on my daughter. I can’t worry,” she said. “God is teaching me to just let it go and to rely completely on him, in him — not on my own understanding.”

God’s help has come in many forms, Amy said, like from her mother, who left her missionary work in the Dominican Republic to come help the family.

Natalia’s American Heritage Girl Scouts troop has been an enormous help as well. It was through the troop’s church, Christ Church of Lutz, that Seal Swim School adopted the family for Christmas. The church also provided 40 frozen meals for the family, and bought them a freezer.

Members of the Ricabals’ church — Exciting Idlewild Baptist Church — have stepped up, too. A group of church friends did a makeover on the family’s yard. They also pressure washed the driveway. When they heard the family’s water heater was giving out, they got them a new one.

People have provided gift cards for groceries and have shopped for them, too, Amy said.

One recent day, Natalia was at Lutz Prep with her mom, grandmother Nydia Torres and her Chihuahua, Beatrice. The child was sitting in a wheelchair with a big cast on her leg, but she was smiling and talking about how special she feels because of the kindness of classmates and friends.

Amy said she’s been trying to teach her daughter to see the blessings that are hidden within the challenges they face.

“I tell her, ‘Look, Praise God that we still have a leg. Period,’” she said.

Amy also reminds herself to remain positive, telling herself, “This is something you’re going through. You’re going through the valley right now.”

But with God, she added, “there’s always a purpose and there’s also a plan.”

First Fridays aim to raise funds, build fellowship

The Lutz-Land O’ Lakes Woman’s Club is known for the community’s Fourth of July parade. The Lutz Civic Association is known for its annual Lutz Guv’na campaign.

And now the Lutz Citizens Coalition wants to kick off its own signature event.

Beginning Sept. 6, the coalition will sponsor Lutz First Fridays, a food truck rally on the first Friday of each month, aimed at helping to raise money for the community organization and to give residents a place to eat and mingle.

The rally, which will be professionally managed by Generation Food Truck, will have at least 26 trucks, said Jeremy Gomez, who owns the company along with his wife Candy.

The food trucks will offer diverse selections, including everything from kangaroo to gourmet popsicles, Gomez said. He thinks it’s safe to estimate that the monthly event will draw a couple thousand people out for dinner.

Food truck rallies are popular because people like to try new foods, he said.

“People like the variety. They know the trucks aren’t storing stuff in a freezer,” Gomez said. “I don’t even know a food truck that owns a microwave. Most of the foods are locally sourced.”

He also thinks the rally is a natural fit for the community.

“Lutz has always been good for outdoor events,” Gomez said.

Sam Calco, vice president of the Lutz Citizens Coalition, said the monthly gathering will help the coalition raise not only money, but the organization’s profile in the community as well.

“We’ve been an organization for about a year. We derive most of our money from family memberships, $25 a year,” Calco said.

The organization also receives donations from businesses.

The best way to raise money is to get the community involved, Calco said, like the coalition did with its Lutz Biggest Yard Sale in May.

“We learned a lot of things of what to do and what not to do,” Calco said.

With the food truck rally, the coalition will receive a fee from each participating truck and it will handle the drink concessions, Calco said.

He thinks the food truck rally will be a popular community event. It gives people a chance to mingle, to take a break from cooking dinner and to enjoy themselves at a family-friendly event.

Final details are still being worked out, including what time the event will begin, but would likely start around 5 p.m. or 6 p.m., Gomez said. It will end around 10 p.m., unless people come over after a local football game and it needs to stay open longer, Calco said.

The location for the event is still being pinned down, too, but both men expect that to be determined soon.

The Lutz Citizens Coalition was formed about a year ago. Its mission is to preserve Lutz and protect it from unwanted growth, Calco said.

05/28/2022 – Memorial Day Concert

The “Let’s Do Good Memorial Day Concert” is scheduled for May 28 from 1 p.m. to 7 p.m., at Land O’ Lakes Heritage Park, 5401 Land O’ Lakes Blvd., to benefit the Tunnel to Towers Foundation. Tunnel to Towers provides mortgage-free homes to Gold Star and fallen first responder families with young children, and builds custom-designed smart homes for catastrophically injured veterans and first responders. The foundation is committed to eradicating veteran homelessness and aiding the victims of major U.S. disasters. The event will include vendors, gifts, a Forget-Me-Not Garden, and more.
