Elections supervisor encourages early voting, vote by mail

For Pasco County Supervisor of Elections Brian Corley, it’s quite the busy time of year.

His agency on Sept. 24 sent out its mass mailing of approximately120,000 vote-by-mail ballots to residents — roughly a third of the agency’s voter registry file — for the upcoming Nov. 3 general election.

Simultaneously, the elections office is readying early voting sites.

The early voting cycle will run for 13 days from Oct. 19 through Oct. 31, with polls open from 7 a.m. to 7 p.m., each day.

The county added three new early sites bringing its total up to record-high 14 locations for the presidential election, said Corley, who was the guest speaker at an East Pasco Networking Group  meeting at IHOP in Dade City this month.

New sites include Veterans Memorial Park gymnasium in Hudson; J. Ben Harrill Recreation Complex in Hudson; and, the newly opened Wiregrass Ranch Sports Campus in Wesley Chapel.

Another early voting site change — the larger Land O’ Lakes Recreation Complex gymnasium will be used in place of the Land O’ Lakes Branch Library on Collier Parkway, typically the county’s most heavily trafficked site, Corley said.

The elections leader credited Pasco County administrator Dan Biles for approving the early voting location additions and changes — particularly the one in Land O’ Lakes — in the name of accommodating more voters and allowing for social distancing protocols.

“We like big rooms for early voting sites,” Corley told the audience. “Basically, we’re going to be using the (Land O’ Lakes) gymnasium for 13 days. That’s a big ask for the county.”

With that, Corley assured there’s myriad measures in place to ensure the safety of poll workers and voters alike, in regards to the coronavirus.

That includes installation of plexiglass shields around electronic poll books, one-use styluses, hand sanitizer, disinfectants and spacing booths further apart. Many of those procedures helped the August primaries go “very, very smoothly,” Corley noted.

The elections supervisor would go on to discuss the county’s vote-by-mail processes — assuring it’s a safe and secure method to utilize for eligible voters.

He pointed out his agency was the first in the state to implement “Ballot Scout,” a tool which uses scan data for voters to track the delivery of their vote-by-mail ballot through the United States Postal Service (USPS). Voters can view the status of their ballot as being mailed, in transit, or delivered, via text or email notifications.

“You can track your ballot like an Amazon package,” said Corley. “You can see when we sent it out. On our end, we can tell you exactly where it is. When it comes to our office, it’ll automatically text you, ‘We got your ballot back.’”

Vote-by-mail ballots can be requested up to 5 p.m., Oct. 24 at PascoVotes.com, calling (800) 851-8754, or in writing to P.O. Box 300 Dade City, Florida, 33526.

Also on the topic, Corley defended the postal service, which has been politicized in recent months over nationwide concerns about rejected or uncounted mailing ballots.

To avert those issues, the earlier a ballot is mailed, the better, Corley emphasized.

Because vote-by-mail ballots must be received no later than 7 p.m., on Election Day, Corley said, it’s an unwise proposition for someone to postmark a ballot the actual day of the election and expect it to be delivered in time of the deadline.

As an example, placing a ballot in the mailbox at, say, noon on election day may result in your vote not being counted, he said. He noted there were about 600 uncounted ballots returned to his office after 7 p.m., on the date of the Aug. 18 primary.

“That’s not the USPS’s fault,” Corley said. “Let the voter take some responsibility, and get it back early.”

Those who remain leery about vote by mail, or uncomfortable stepping indoors to cast their vote, there’s also an option to bring an absentee ballot to early voting site drop boxes staffed by poll deputies, Corley explained. Ballots in the drop boxes are securely returned to the elections office headquarters at the end of each day.

“It’s like you’re literally handing it to one of my staff — it doesn’t get any more secure than that,” Corley said.

The elections supervisor also talked about the importance of his agency cultivating important partnerships with other county government agencies, such as the school district, sheriff’s office, tax collector’s office and clerk’s office.

That came to a head in this year’s municipal and primary elections, when the agency had some 300 poll workers opt out amid fears related to the COVID-19 pandemic. (The county’s average poll worker age is 66 years old, Corley said.) “I couldn’t blame them,” he said.

To help make up for the shortage, Corley enlisted help from Pasco County Schools Superintendent Kurt Browning, who sent a memo asking if any district employees wanted to fill in as poll workers.

The interest, response and results were overwhelming positive, the elections supervisor said.

“We had more than we needed,” Corley said. “We had teachers, school personnel that had never been a poll worker, never had any training, show up on election day and then hit it out of the park for us.”

Voting in Pasco and Hillsborough counties
The deadline is Oct. 5 to register for the Nov. 3 General Election.

Pasco Sheriff’s Office appreciates community’s support

Amid nationwide protests and movements for widespread police reform, Pasco County is fortunate to receive considerable community support, said Pasco Sheriff District 2 Cpt. Joseph Irizarry during a breakfast meeting with the East Pasco Networking Group.

Protesters have been persistent, and sometimes violent, in calls for reform in the wake of multiple officer-involved shootings across U.S. cities, but Pasco deputies have felt appreciated by the “support that’s been pouring out of the community,” said Irizarry said, whose patrol division runs east of U. S. Highway 41 north to the Hernando County line, south to the Hillsborough County line, and east to Polk and Sumter counties.

“You know, you can’t go anywhere in Pasco County pretty much without getting ‘thank yous’ and someone offering to pay for my meal or to buy me a cup of coffee — so it’s greatly appreciated,” he told the group, gathered for the Aug. 25 breakfast meeting at the IHOP in Dade City. “Unfortunately, many other law enforcement agencies aren’t experiencing the same support that we experience here in Pasco County.”

The district 2 captain said the reelection of Sheriff Chris Nocco has helped the department stay focused on county issues. No one stepped forward to challenge the sheriff, in his bid for reelection.

Touching on the county’s more pressing issues, Irizarry said the agency has placed a significant emphasis on the issues of homelessness and mental health.

He applauded Nocco’s progressive approach in addressing community issues. For instance, the sheriff used grant money to form the Behavioral Health Intervention Team (BHIT) last year.

The unit, made up of 12 detectives, partners with local hospitals and mental health facilities to conduct frequent visitations and welfare checks. It also helps expedite referrals for behavioral health resources and criminal justice diversion programs for the county’s Baker Act repeats.

For example, an individual struggling with addiction may be referred to outpatient substance abuse treatment. Or, someone struggling financially might be referred to Pasco County’s Human Services department and the county’s homeless coalition.

Before the proactive program began, Irizarry said, the sheriff’s office would be called to a scene and make initial contact with someone who was in the midst of a mental health crisis — and that individual might be arrested or submitted for an involuntary mental health evaluation (Baker Act).

From there, it was left to others to address the problems.

But, the law enforcement agency discovered that many struggling people end up going back to square one — spiraling into their various issues, without knowing how or where to turn for help, he said.

“The sheriff kind of took the reins, ‘Hey, we’re going to create a unit, we’re going to be that ‘somebody else,’ and we’re going to follow up,” said Irizarry, who’s held various roles in his 20 years with the law enforcement agency, including patrol deputy, K-9 deputy, and vice and narcotics detective.

Meanwhile, the high-level officer noted that less than 20% of service calls are related to criminal complaints, so the majority of calls are related to non-criminal matters such as mental health and substance abuse problems, among others.

“A lot of our time is spent doing things other than arresting people and taking people to jail,” Irizarry said. “It’s trying to get people help, and use resources in the community or in the area.”

That seems more important than ever, as many individuals and families have been struggling through layoffs and furloughs due to COVID-19.

Recently, the sheriff’s office has been partnering with Feeding Tampa Bay to deliver hundreds of meals to families at the Pasco County Fairgrounds.

It’s about making the county “a better place for everybody to live,” the captain said.

“In this day and age with the pandemic, a lot of people are laid off, so they don’t have the money to pay the bills or pay the rent or pay for food…so there’s a lot of things that the sheriff’s office does to help the community.”

Pasco Tax Collector’s Office back in business

After closing its doors for nearly a month amidst the COVID-19 pandemic, the Pasco County Tax Collector’s five countywide branches are back open for business.

And, they’ve been quite busy ever since reopening, Pasco County Tax Collector Mike Fasano said during an East Pasco Networking Group virtual meeting earlier this month.

Besides handling various tax payments, Fasano said his office has had an influx of other requests of late, such as road tests for driving licenses, hunting and fishing licenses, issuing applications and renewals for concealed weapons permits, and more.

In fact, concealed weapons permits, specifically, have shot up in recent weeks, he said.

Concealed weapons permits are offered at three of the county tax collector’s five offices — in Dade City, Wesley Chapel and Gulf Harbors, respectively.

And, those offices recently have been “overwhelmed” with the number of people seeking concealed weapons permits, Fasano said. Over 100 permits were issued each weekday in the first week of June alone, he said.

Fasano observed of the influx: “I won’t expand as to why, I can only assume, of what is happening throughout this country and throughout this world. This happens a lot, whenever there’s some unrest, of any sort, we see a large population of people coming in, old, young, and they’ve come into our three offices that we provide weapons permits.”

Fasano added “the vast majority” of weapons permits issued are from people who’ve never had one before, while some others were simply renewals. He went on to mention the three branches provide a “one-stop shop” in offering applications, fingerprints, photographs and related services for concealed weapons permits; it usually takes a few weeks for new permits to be issued, pending state approval, he said.

Revenue shortfall, payment assistance programs
While tax collector’s offices and lobbies were closed for much of April, the government agency did provide many services through its website, call center and by mail.

However, the agency still took a “significant revenue loss” during that period in most everything but property taxes, Fasano said. That included fees collected from providing motor vehicle services, title work, birth certificates, concealed weapons permits and so on.

But, despite the shortfall in fees, Fasano noted his office didn’t have to lay off or furlough any of its 200 or so employees.

Said Fasano, “We were able to do things so that no one got laid off, no one lost their job, no one had to collect unemployment, and everybody stayed in their position, working every day, five days a week, and it’s been successful.”

The Pasco County Tax Collector’s Office has reopened all five of its countywide branches.

Meanwhile, for those residents who’ve been laid off or furloughed in the wake of COVID-19, the tax office has multiple payment assistance programs for those struggling.

Fasano mentioned there’s quarterly property tax payment plans, as well as partial payment options, where residents can pay increments of at least $100 at a time.

As a sign of the present economic hardships, Fasano noted his office has been forced to issue roughly 1,000 more tax lien certificates (an enforceable first lien against the property for unpaid real estate taxes) compared to this time last year.

“We had a lot of phone calls from people who were having some difficulty paying their taxes this year,” Fasano said. “It’s just a sad situation for everybody.”

COVID-19 safety measures implemented
The tax collector also outlined how each branch has taken additional safety precautions since reopening, in the wake of COVID-19.

Those precautions have entailed spreading chairs 6 feet apart; installing countertop shields to create a barrier between representatives and customers; encouraging — but not mandating — customers to wear masks; and, limiting the amount of customers in the office at any one time.

Additionally, tax collector has developed a text message notification system that alerts waiting customers when they’re ready to be serviced. The technology provides an added layer of social distancing, Fasano said, as customers can choose to sit in their car or wait outside until they’re alerted that their ticket number will be called shortly. It’s similar to how restaurants sends texts to guests for waitlist updates and automatic reservation reminders, he said. The service is already underway at the Wesley Chapel office, and should be available at all five offices in forthcoming weeks, Fasano said.

Said Fasano, “We think that’s going to go a long way in, I hope, in more social distancing and trying to comply with the governor’s (Ron DeSantis) suggestions.”

Pasco School District adjusting amid COVID-19 pandemic

Whether its drive-thru feeding sites or widespread distance learning, the coronavirus disease-2019 (COVID-19) pandemic has created myriad logistical challenges for school districts nationwide.

Pasco County Schools is no different — operating as the state’s ninth-largest school district, and 49th largest in the nation.

Even so, Pasco Schools Superintendent Kurt Browning is maintaining an upbeat outlook in what has otherwise been a trying situation over the last two months or so.

Speaking to the East Pasco Networking Group at a May 12 virtual meeting, Browning acknowledged the pandemic “really stretched the school district,” but credited district leaders and administration for “very quickly” pulling together a large-scale distance learning education program once it became apparent the remainder of the 2019-2020 school year would be remote.

Pasco Schools was more prepared than other surrounding counties, Browning said.

That’s because the district already had “a very robust virtual education program” known as Pasco eSchool, which typically serves more than 3,000 students in a normal year.

“It wasn’t easy, but we were better positioned than a lot of districts even surrounding us,” the superintendent said.

Unlike other districts, too, Browning added Pasco School instantly pushed out lesson plans for most courses to the virtual learning platform, rather than requiring teachers to develop a curriculum to post online, on the fly. “I think the teachers were appreciative of that because that was less on their plate that they had to work with,” he said.

As for how and when brick-and-mortar schools will open back up, Browning said district staff is having ongoing meetings to brainstorm various scenarios and possibilities, keeping in mind recommended social distancing health and safety protocols. Virtual learning will continue through summer school, he said.

At least one thing’s for sure — traditional schooling will “look different” compared to how things were before the pandemic, Browning said.

The superintendent observed, “Normally, you would have had 45 kids on a school bus, you can’t put 45 kids on a school bus anymore, if you’re going to social distance. How are you going to feed a school of 700 kids in a cafeteria, if you’re going to social distance? …We’re going to have to move and move pretty quickly, so we can let moms and dads know.”

If there’s one positive result from the coronavirus pandemic, parents and families now have “a greater appreciation” for educators overall, Browning said.

Said Browning, “I think the teaching profession, over time, has been diminished and just had a rough go, but I do believe that parents will have a better idea what teachers have to put up with and deal with on a daily basis to ensure that their children are learning.”

With that, Browning noted Pasco School teachers have done a solid job engaging and interacting with students on Zoom calls throughout the pandemic. “I am so, so proud and pleased where our teachers and where our administrators have taken us,” he said.

However, the superintendent later acknowledged the virtual learning setup has proved tough for servicing the district’s special needs population.

“It is an area we’re really going to have to spend some time in to make sure those kids do not get shortchanged,” he said. “We’ve been getting through it but, I do think going forward, we’ve got to have a more sustainable process to deal with kids with special needs.”

Providing devices, Wi-Fi, meals and more
Maybe the largest hurdle to implementing distance learning to all schools was ensuring all students had access to computers and tablets.

Browning said the county loaned roughly 20,000 electronic devices to students districtwide, which were distributed curbside at various schools.

The superintendent admitted he initially felt uneasy on the thought of loaning expensive electronic devices to grade school students.

Said Browning, “I cringe every time I think of this, because we’re giving an $800 device to a student, and we’re hoping and praying it comes back to us in one piece. But, we knew we had to do it. Personally, I had to get beyond that because I knew that if we wanted to get kids to continue to learn, we had to provide them the device.”

Ensuring all students had a viable Internet connection at home created another obstacle, Browning said.

Even in this technological day and age, the superintendent came away “surprised at the number of our kids that don’t have Wi-Fi” at their home.

To resolve that, the district has issued home hotspots to families and organized a handful of community hotspot hubs in remote areas, such as Crystal Springs. Here’s how it works: The school district positions a mobile hotspot vehicle at a local church or community center, allowing parents to drive up and have their children do complete online schoolwork and lessons from inside their parked car, during predetermined dates and times.

“We know it’s not easy, but nothing about COVID-19 has been easy for us,” Browning said. “The fact is we want our kids to continue to learn, so at least by providing those hotspots in those community hubs, at least we’re giving them the opportunity to have them get their lessons done, get their studying done and be caught up as best they can during this really weird time we find ourselves.”

Besides technology offerings, ready-to-go, prepackaged meals is another service the school district has been offering amid the coronavirus pandemic.

The district hit the 1-million meal mark last week.

The district’s food nutrition services department initially offered meals for pickup five days a week, but since transitioned to distributing all 10 meals (breakfast and lunch covering five days) per student, picked up once per week. As an example, a family with four school-age children could swing by a particular curbside feeding site and pick up 40 free meals for the week.

Browning mentioned even under normal circumstances school-provided meals might be the only opportunity for many students to eat, particularly those coming from the county’s Title I schools (whereby a large percentage of a particular school’s student population is eligible for free or reduced lunch).

“It’s been a lot of work on the school district, but that’s what we do. We care for people, in addition to educating people,” said Browning.

Elsewhere, the superintendent also touched on a number of other district-related matters:

  • Pasco Schools graduation rate sits at 88.7 percent, “the highest they’ve ever been,” said Browning. “It’s not where I want them, but we’re moving in the right direction.”
  • Pasco Schools is one of two school districts in Florida named to the College Board’s AP (Advanced Placement) District Honor Roll, for increasing access to AP for underrepresented students while simultaneously maintaining or increasing the percentage of students earning AP Exam scores of 3 or higher. DeSoto County was the other recognized school district in the state.
  • Browning said the district will make “a huge College Board announcement regarding the opportunities we’re providing our kids,” sometime after Memorial Day weekend.
  • The Kirkland Ranch Academy of Innovation technical high school in East Pasco will break ground this fall and will open in August 2022. Browning added the district also is building a K-8 school nearby that’ll feed into the technical high school, which is being built at the corner of Curley and Kiefer roads, in Wesley Chapel. “It’s going to be easy to get to from Zephyrhills, Dade City, Wesley Chapel,” Browning said of the forthcoming technical school. “Not only is it a pretty cool building, but there’s going to be some great programs in there that are going to be able to prepare our kids for jobs.”

Pasco Clerk’s Office upgrades website, online features

The last time Pasco Clerk & Comptroller Nikki Alvarez-Sowles spoke with the East Pasco Networking Group (EPNG), she vowed to make various technological and customer service upgrades to the agency’s website and operations.

Less than a year later, some of those goals have been achieved.

A recent addition to the clerk’s website is e-Notify, a new statewide alert system to stay informed about upcoming hearings, trials and other criminal court events.

Users who sign up for the service receive email or text alerts on upcoming events, with options to get reminders 14 days, seven days or a day ahead of time.

The program works similar to the way individuals receive electronic reminders for upcoming doctor’s appointments “except it relates to cases,” said Alvarez-Sowles, who led a virtual video presentation with the networking group last month.

The e-Notify system is not just for parties and attorneys, but the public and media, as well. “It is open to the world,” she quipped.

In addition to providing information on an appearance date, time and location, it also alerts when a defendant or witness doesn’t show for a particular event, said Alvarez-Sowles, who became the eighth Pasco County Clerk & Comptroller last August, filling out the balance of term for the retiring  Paula S. O’ Neil.

There is no limit to the number of cases users can sign up to get notifications, and users can manage their alert subscriptions and make changes to the number of followed cases and frequency of alert.

In addition to e-Notify, the clerk’s office also has installed bolded tabs at the bottom of its website for “highly sought after information,” such as marriage licenses, property auctions, juror information, e-Filing and legal resource center services, to ease in searches.

Alvarez-Sowles also talked about the agency’s online property fraud alert system.

That alert system helps protect a person’s property from fraud by monitoring documents, such as liens, deeds and mortgages that are recorded in Pasco County.

It provides peace of mind because property owners know that their property is being monitored against the filing of fraudulent documents in their name.

Alvarez-Sowles put it like this: “If someone records a document in the official record with my name on it, I am going to get an email or phone call telling me that a document was recorded with my name on it, and give me the information so that I can go and look.”

The clerk explained there’s “a lot of fraud going on in our official record” — detailing how many fraudsters file quitclaim deeds on someone’s property then sell it to another party “so you no longer own your property on public record.”

To drive the point home, the speaker shared a heart-wrenching story about a Miami area woman who was homeless for seven months after swindlers used forged quitclaim deeds to sell her home to an investment firm, leading to her eviction.

“Our home or business we own is probably the largest asset that we will own, and we need to protect it,” she said.

All sorts of information available online
The website also offers online searches for court records.

The public can do anonymous criminal background checks on Pasco County-based businesses and residents. There’s also specific lookups for animal abuse cases, high-profile cases, mental health cases and others.

For example, you can search a person or business name and see lawsuits and criminal and civil charges, among other court records.

Alvarez-Sowles explained the database provides a way for citizens to vet doctors, lawyers, building construction, housecleaning, landscaping and other service providers.

It also can be used to research a new neighbor moving in, to see if they have a prior record in the county, she said.

To underscore the feature’s significance, Alvarez-Sowles shared a news story of two maids who’d been charged with stealing electronics and a firearm from a Cape Coral area home they were hired to clean.

A simple court records search in Lee County likely would have revealed each of the individuals criminal history, she said.

“Just think of any services people are providing, you can go and protect yourselves by going and looking at our records online,” she told the networking group.

On a related note, Alvarez-Sowles said she’s collaborating with other county clerks to get permission from the Florida Supreme Court to consolidate court records statewide for public consumption. That would allow for individuals to search a person or business name and see all court records cases from all Florida counties simultaneously and not require individual searches of each county.

Such a system currently is only accessible by the courts, law enforcement, state attorneys and public defenders.

Alvarez-Sowles said one her next big initiatives will be to expand online payments through the clerk’s website. Currently, citizens can pay traffic tickets and child support online, but she’s working to make it possible to pay court fines, fees and infractions online.

“I want it so that you can pay anything that you owe online, without having to come in (the office),” she said.

She’s also looking to contract with Amscot to accept payments on behalf of the clerk’s office, to assist individuals who don’t have bank accounts.

“To be honest, in Pasco County there’s a lot of people that don’t have bank accounts and they just live on cash, so having a place like Amscot for them to go is also very helpful, so that is a work in progress,” the clerk said.

The recently passed $93 billon Florida state budget included some big wins for East Pasco, but District 38 state Rep. Randy Maggard isn’t ready to celebrate or take a victory lap just yet.

That’s because the coronavirus disease-2019 (COVID-19) pandemic will force state lawmakers back to Tallahassee for a special session sometime this summer — and likely result in major spending cuts for budgeted programs and projects due to a shortfall in sales tax revenues.

“This virus, it’s just going to decimate our budget,” Maggard said, during an East Pasco Networking Group virtual conference meeting on April 13.

The Dade City Republican helped secure a total of $16.6 million in appropriations to be used in projects by Zephyrhills, Lacoochee, Pasco County and Saint Leo University. These projects include intersection improvements, establishing a new robotics program, and septic to sewage for a fast-growing part of our county.

But, the freshman lawmaker admitted he isn’t sure which, if any, of those projects could be on the chopping block a few months from now.

“The problem we’re in, we all don’t know what’s going to change on us,” Maggard said. “All the good things we accomplished may not last, so that’s what we are dealing with at the moment and just watching, because It’s unchartered waters for all of us.”

Aside from budgetary impacts, Maggard outlined other issues that have or could become the result of COVID-19.

One of the more well-documented issues surfaced is the Florida Department of Economic Opportunity (DEO) having trouble managing the massive volume of people filing for unemployment benefit claims.

Maggard mostly defended the DEO — pointing out the system was never designed or could’ve anticipated such unemployment levels in a state with historically low unemployment.

The lawmaker explained the DEO would typically file more than 10,000 unemployment claims in a month. Now, the department is getting as many or more in a single day.

“I think you’ve gotta put it in perspective a little bit,” Maggard said. “Nobody expected this to happen and where it’s going. Nobody expected it in our unemployment part and in our small businesses and our restaurant businesses. I just feel so bad for them, because it’s devastating…so we’re working tirelessly to try to do the right things to get us through this as quick as possible.”

He added “99% of what I do daily now is trying to help people get unemployment claims and fight it through the system.”

Maggard touched on some other unintended consequences resulting from COVID-19.

He explained statewide stay-at-home orders have led to a rise in domestic violence, and strains on waste management, while consumer stockpiling has exposed a truck driver shortage and product supply chains.

Maggard also raised concerns of the risk of utility and electric companies being overwhelmed as “everybody’s staying home under A/C, 24/7…and we haven’t even hit the summer hot time yet.

“This virus has really compounded a lot of problems and shows us a lot of weaknesses and some of the things we thought we had set up and were foolproof,” he said, “but, the good thing is we’re learning from it, we’re going to get through it…and there’s a light at the end of the end of the tunnel.”

Maggard reflects on first year in office
Voters selected Maggard in a special election last June to become their next representative in District 38 of the Florida House of Representatives — filling the vacancy created by former Rep. Danny Burgess, who accepted an offer from Gov. Ron DeSantis to become the executive director of the Florida Department of Veterans’ Affairs.

Participating in his first 60-day regular legislative session “was absolutely one of the biggest honors of my life,” Maggard said, adding, “to be able to walk out on that chamber floor and realize you’re one of 2,700 people that ever stepped there, it gives you chills.”

Maggard spent 30 years as vice president of Sonny’s Discount Appliances in Dade City. He is a Pasco County native, attended Zephyrhills High School and holds an Associate of Arts degree from Pasco-Hernando Community College (now known as Pasco-Hernando State College).

He underscored the significance of his new role.

“Every time we press a button, we affect 21 million people’s lives,” Maggard said, “and I take that very seriously.”

With that, stopping a bill is oftentimes more important than passing a bill, Maggard said, “because every time something is passed, something is taken away, there’s some kind of freedom affected.”

“I quickly learned that my job up there was to stop things — bad policies — more than it was trying to make good policy, so I did a lot of arguing, debating over that,” he said.

For Maggard, the job overall has been “like drinking from a fire hose”  — in terms of the volume of tasks and issues that come across his desk regularly.

“When you’re running for office, you can’t really get prepared for all the amount of information that you need to use, and the people you need to see, and the work you have to do to be able to vote the right way for your citizens in Pasco,” he said.

Meanwhile, Maggard commended fellow state lawmakers for working together and across the aisle, as both the House and Senate unanimously approved the $93 billion state budget in March.

He highlighted the procurement of $690 million for water protection and restoration of the Everglades; $1.7 billion dollars for hurricane response; and, $17 billion for PreK-12 education funding, including $500 million for teachers pay raises, among others.

“The Republicans and Dems, we do have some differences,” he said, “but, we can sit down and have a breakfast, both sides, and talk and work something out, and I think that’s what good government’s supposed to be.

“We were called not to be politicians, but to be statesmen. I’m arguing for East Pasco, but somewhere in the middle there, we’ve gotta do what’s best for 21 million people.”

Judge enjoys challenges in civil court cases

Judge Kent Compton recently paid a visit to the East Pasco Networking Group —where he discussed his duties in the Sixth Judicial Circuit of Florida.

The former Zephyrhills city councilman, and longtime lawyer and prosecutor took up the post in January, after being elected in August 2018.

While still settling in, Compton clearly enjoys his new gig at the Historic Pasco County Courthouse building in Dade City.

“I feel like I’ve got the best job in the state of Florida,” Compton said, during the Nov. 26 breakfast meeting at IHOP in Dade City. He said he finds the position to be “very refreshing.”

He went on: “I love criminal law, but I love the civil law and I love everything new about it, and the challenges and the opportunity to do something different, to research something different, to hear the stories, —I enjoy that.”

Compton presides over county civil cases handling principal issues $15,000 or less, small claims and traffic court, as well as first appearance advisories. He also is on-call for emergency petitions for arrest warrants, search warrants, Marchman Acts, Baker Acts and so on.

On an emotional level, Compton said eviction hearings are “the hardest part of my job.”

He explained: “I’ve had some very unhappy people, particular in evictions. I’m human, but I have to follow the law, and Chapter 83 (of the Florida state landlord-tenant statutes) gives me fantastic direction on what to do. If the money’s not paid, if the right motion isn’t made, then people are disappointed.”

Compton added, “it can be kind of hairy — very specific notices, requirements of what the landlord has to do, what the tenant has to do.”

He also mentioned that conducting traffic court can become “quite a scene,” noting his courtroom will be filled with 20 or 25 law enforcement officers and another 50 people waiting for their case to be heard. There also can be “a little gamesmanship” between law enforcement officers and violators who’ve been issued a ticket or citation.

Violators “will come to court taking the gamble the law enforcement officer doesn’t show up,” he said. If that happens, Compton said he will dismiss the case “99% of the time.”

If the law enforcement officer is present, however, Compton said the violator usually will enter a plea to close the case.

In more substantial traffic matters, such as car accidents, Compton said there’ll be “a full-blown hearing” between a defendant and plaintiff.

That typically includes witness testimony, as well as video and photographic evidence.

Those cases, he said, can be challenging because it becomes “a credibility contest.”

Testimony between defendants and plaintiffs can be “just unbelievably 180 degrees separate,” Compton said.

In judging those matters, he said: “You rely upon your common sense and your life experience to try and decide who’s telling the truth, but sometimes I can’t tell, and if that’s the case, it’s not guilty.”

On the other hand, though, “Sometimes it’s pretty obvious the person is caught in their own lying,” he said.

When he’s unsure how to decide a case, the judge said, he’ll take it under advisement to research an issue further, study case law and lean on the experience of his fellow peers in the courthouse and judges throughout the state.

“I have the great resource of all the other judges who are very helpful to me if I have any indecision,” Compton said.

The speaker drew parallels between the courtroom and his dozen-plus years on the city council:

“It’s a people business. You must listen, and you must be fair and courteous. It’s the same job, there’s just a lot more legal mumbo jumbo to go along with it.”

Those qualities are something Compton reminds lawyers and others that enter his courtroom, he said.

Said Compton, “The lawyers, it’s basically a confrontation of business, but while we have to do zealous representation, we also need to have professional courtesy amongst each other and the court.”

When asked how the job differs from what he expected, Compton said, “I didn’t realize that I would see a stack of paper every day. I spend an hour and a half, two hours every day just going through paperwork and processing evictions or motions for summary judgement or credit cards, stuff like that.”

He also was surprised by the quantity of nonjury trials that he handles in the civil division.

New Pasco clerk seeks technology upgrades, more

New Pasco County Clerk & Comptroller Nikki Alvarez-Sowles isn’t wasting much time in trying to implement some new initiatives within the clerk’s office.

She was formally appointed by Gov. Ron DeSantis last month, following the retirement of her predecessor, Paula O’ Neil.

The new clerk outlined a number of her ideas during an Aug. 27 East Pasco Networking Group breakfast meeting in Dade City.

One of her primary aims, she said, is to boost the office’s technology capabilities, which will improve efficiency and cut costs in an agency that staffs over 300.

The technology improvements include the development of a case management system, which would provide electronic court files to the county’s Sixth Judicial Circuit, she said.

Alvarez-Sowles pointed out that Pasco County is the only one out of 67 counties in the state that still requires paper files.

That system costs her office time and money, she said.

“We have this huge, expensive budget related to paper…so what we’re trying to do is leverage our technologies,” she said.

Related to that, Alvarez-Sowles said her office is developing an automated docket program to streamline simple actions, such as indexing case numbers “to take the workload off of the team, so they can focus on the more complex and complicated functions.”

Alvarez-Sowles said she’s also looking into the feasibility of organizing attorney consultations within the clerk’s legal resource center at both county courthouses in Dade City and New Port Richey — to help unrepresented individuals or those unable to afford an attorney in civil matters related to divorce, residential landlord/tenant, small claims and so on.

The program would model larger counties, such as Orange, Palm Beach and Pinellas, Alvarez-Sowles said, whereas the clerk’s office partners with local general practice attorneys to offer 15 minutes or so of legal guidance, at a rate of about a $1 per minute. The program could take at least a year to implement, she said.

Alvarez-Sowles said the affordable consultations “wouldn’t create an attorney-client relationship, but it just gives (unrepresented individuals) the ability to maneuver through and know that they can do it on their own.”

She underscored the need for such a service in the county: “So many times, people come to our front counter and we cannot give them legal advice. We know that they need to file a motion, but we can’t say, ‘You need to file a motion,’ because we’ll get in trouble for the unauthorized practice of law…”.

More generally, Alvarez-Sowles in her new role said she wants to build upon the office’s values of compassion and helpfulness toward others.

“When someone comes to our office, we don’t judge them,” the clerk said.

“People coming into our world in the clerk’s office, for the majority, they’re on like the worst time of their life. They’re coming in, they’re scared, they’re stressed out, they’re hurt, they’re angry, they’re not in a good place.

“We can pull up their case information and see what’s going on in their life very quickly  and easily, but at any time, any one of us could be on the other side of that counter… so whatever it is, we’re here to help them find a better day, we’re there to help them get to that better day.”

Alvarez-Sowles is the county’s eighth clerk and comptroller.

She was named an interim successor by Sixth Judicial Circuit Chief Judge Anthony Rondolino, upon O’ Neil’s retirement on July 1. She received DeSantis’ appointment on Aug. 9.

Alvarez-Sowles is filling out the balance of term for the post vacated by O’ Neil.

The new clerk said at the breakfast meeting she plans to run for election in 2020. “I will be putting my name in. I do intend to run,” she said.

Prior to her appointment, Alvarez-Sowles was serving as the clerk’s office chief operations officer (COO) under O’ Neil since 2010, a position she said is still unfilled.

The transition to the more senior role has been seamless for her, she said, however, it comes with added responsibility.

“There has been no hiccups, nothing that has tripped me up,” Alvarez-Sowles said. “The difference is before, I would do the research and make a recommendation. And now, I make the decision, so the pressure is a little more weight on the shoulders.”

The new clerk also gave kudos to her predecessor.

She said of O’ Neil: “I had one of the best mentors anyone could ever have asked for, her community outreach and her caring for our Pasco County.”

Born in Tampa, Alvarez-Sowles played soccer at the University of South Florida then earned her law degree at Thomas M. Cooley Law School in Lansing, Michigan.

From 2000 to 2005, she practiced real estate law with the Tampa firm of Echevarria, Codilis & Stawiarski P.I., and spent a year as real estate development manager for the nonprofit Housing & Education Alliance Inc., before joining the Palm Beach Clerk & Comptroller’s Office as director of branch court services.

Alvarez-Sowles said she stopped practicing law because “it didn’t fill my cup up of what was my purpose.”

Her purpose instead, she said, lies in the public service arena because “that’s how I feel I can give back to our community.”

Offering convenient way to combat breast cancer

Cheryl Hinton hits the road in the quest to prevent breast cancer.

Hinton, who is the marketing and promotions specialist for Tampa Bay Mobile Mammography, was the featured speaker at the East Pasco Networking Group’s breakfast meeting on Aug. 13 at the IHOP in Dade City.

She talked about the company’s mission to provide convenient breast cancer screenings. The independent organization began in New Port Richey. It now provides its services not only in Pasco, but in Hillsborough, Pinellas, Polk and Sarasota counties, too.

The staff works out of three tour-size buses, which are parked at various locations. Female employees can step away from their work at those places, to undergo a breast cancer screening.

“We actually go to schools and corporations,” Hinton explained. “We bring the bus to them, so that all they have to do is go outside, get on the bus, get their mammogram done, and go right back to work.”

Inside the bus, women take several minutes to be examined, using a digital three-dimensional imaging machine.

Patients also may be referred to a physician for further analysis.

Beyond her current role, Hinton also has a history in community advocacy, having worked in conjunction with organizations like Meals on Wheels and The Samaritan Project.

After she ended her career in newspaper advertising, she found a role where she could promote health.

She recalled: “I see on Facebook that this position is opening and I thought ‘Mobile mammography, what’s that? That sounds interesting.’”

The job also had a personal significance, as her sister-in-law had succumbed to a seven-year battle with breast cancer.

The Zephyrhills resident initially began overseeing operations in Hillsborough County and eventually added Polk County.

“Part of my job is I sit [at] home on my laptop, contact the schools and let them know that we’re coming,” Hinton noted.

She also travels to the companies and schools within her districts to answer questions from employers or employees.

Mobile Mammography tries to accommodate educators by paying substitute teachers to cover their classes while they are in the bus for screening.

The organization had its first summer screening program this year, sending out flyers and visiting 27 schools where summer classes were being held.

The response was phenomenal, she said.

Although the services target women in the school system and the corporate world, women of all backgrounds are encouraged to jump aboard the bus – and for good reason.

According to the Centers for Disease Control and Prevention, breast cancer is the most common type found in women, not counting skin cancers .

In 2016, there were over 245,000 new cases reported in the United States alone.

The screening may seem intimidating and does bring about slight discomfort, Hinton acknowledged. However, she added, it could help prevent or stop the progression of breast cancer.

Hinton also was quick to point out that while the disease is prevalent among women, men too, are susceptible to breast cancer.

While Mobile Mammography does not offer services to men, it strongly recommends that men get routine check-ups, Hinton noted.

Toward the end of the meeting, the East Pasco Networking Group presented Hinton with a Standing Ovation Award to recognize her for her community efforts.

Former Miss Pasco keeps busy with acting, modeling

Leja Apple has surely kept herself busy in the years since being crowned 2013 Miss Pasco.

She has a burgeoning modeling and acting career — appearing in various commercials, infomercials and independent films. She’s also an on-air host at HSN, peddling hair and makeup products.

On top of that, she’s an adjunct professor of speech communication at St. Petersburg College and a sales event coordinator at The Birchwood in downtown St. Petersburg.

Plus, she is working toward her PhD in organizational leadership from Northcentral University.

So, how does she manage it all?

“Coffee is definitely my greatest friend,” Apple said, with a chuckle.

Apple, who lives in St. Petersburg, was the featured guest speaker at the East Pasco Networking Group’s July breakfast meeting in Dade City.

She used the forum to share her thoughts on the importance of verbal and non-verbal communication in business and sales.

She also discussed her career and life after pageantry, in a sit-down interview with The Laker/Lutz News.

While she doesn’t get to visit Pasco as often as she’d like, Apple has fond memories of regularly attending the Pasco County Fair, the Kumquat Festival and Main Street Zephyrhills festivals.

She recalled taking part in such events well before being awarded Miss Pasco and during her year of service in the role. Her older sister, Andrea Apple, was Miss Kumquat in 2009.

Apple admired Pasco for being a close-knit, faith-based community that “looks out for one another.”

“I just always have loved this area,” Apple said. “Even though you’re in a populous area — you’re less than an hour from Tampa — you still get that community, kind of country, small-town feel, and I love how everybody helps out each other.”

Apple competed in pageantry from 2007 to 2014. She won five local titles during that span, including Miss Largo and Miss Pinellas; she also finished in the top 10 in Miss Florida voting in 2014.

Being Miss Pasco ranks among her favorite pageant experiences, Apple said.

“It was fun. It was definitely a surprise, of course, winning, but it was fun,” she said.

Aside from the crowns and ribbons, Apple cherishes the lasting relationships she built through pageantry.

“You get to meet so many great people with competing,” Apple said. “Some of the girls I competed with I’m still friends to this day; we hang out with each other. One girl, she used to call it the “Miss Florida Sorority,” because you got to see a lot of the same people.”

She enjoys running into the contestants. “It’s always so fun to see where life has taken them,” she said.

Apple also appreciates the scholarships she won through pageantry, and the professional development offered along the way.

Said Apple, “The great thing about pageantry is just how much confidence that you earn and the public speaking.

“It definitely has opened doors and given me opportunities to share what I’ve learned.”

Ultimately, Apple wants to become a professor and teach online full-time, while having the flexibility to pursue acting and modeling.

The former Miss Pasco clearly enjoys the latter, but acknowledged show business “is all over the place” and “comes and goes” in terms of being able to maintain a steady income.

Sometimes, she said, “I’ve had something every single day for months and then other times nothing for six months, so it just really kind of depends.”

That said, some of her most gratifying experiences have come through commercials and infomercial work — including a gig for Thermacell mosquito repellent, in which she pretended to be bitten by mosquitos while hiking.

“They’re so much fun,” she said. “The overreacting and everything, it’s always neat to see that.”

Apple noted she’s sometimes taken aback when she sees herself on late night television, plastered across a billboard, or pictured on the back of a bus.

She recounted seeing her likeness in a Walmart print ad for Fruit of the Loom’s thermal wear. “It was kind of weird walking through Walmart and you’re like, ‘Hey, that’s me on the package,’ she said.

Then, she purchased “like 50 pairs” of the brand’s thermal wear in the store. “The person at the checkout counter was probably like, ‘What is wrong with you?’” she said, poking a little fun at herself.

Apple clearly considers her pageantry experience as being beneficial to her life, and she offered some words of advice for anyone aspiring to become Miss Pasco.

“Just go for it,” Apple said. “Even if you’ve never competed in a pageant before, even if you’re a pageant queen and have always done it — you will learn a lot about yourself, you will learn a lot about how much you can push yourself and put you outside of your comfort zone.”
